Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the HoiiiBlock mobile application and related services (collectively, the "Services") operated by Kacci Lab Inc. ("Kacci Lab", "we", "us", or "our").

By downloading, accessing, or using HoiiiBlock, you agree to these Terms. If you do not agree, do not use the Services.

1. What HoiiiBlock Does

HoiiiBlock is an app-blocking and quick exercise application designed to help users reduce distracting app use. The app allows you to select apps to block, complete guided exercises, and unlock selected apps for a configured time window after completion.

The basic HoiiiBlock flow is: choose apps to block, complete a short exercise when you try to open a blocked app, and unlock access for the time window you selected.

HoiiiBlock is intended to support healthier digital habits. It is not intended to be a medical, therapeutic, professional fitness, addiction treatment, parental-control, security, or compliance-monitoring service.

2. Eligibility

You must be at least 13 years old to use HoiiiBlock. By using the Services, you represent that you meet this age requirement and have the legal capacity to agree to these Terms.

If you are using HoiiiBlock on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

3. Account Optional

HoiiiBlock can be used without creating an account. If you choose not to sign in, your app data may remain only on your device and may be lost if you delete the app, reset your device, or change devices.

If you choose to create or sign in to an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate information when creating or managing an account and to notify us promptly of any unauthorized access or security concern.

4. Local Data and Optional Cloud Backup

HoiiiBlock is designed to be local-first. Core app settings and app-blocking information are stored on your device. Optional cloud backup or sync may be available for limited supported progress data, such as streaks and daily exercise totals.

Your blocked-app list is not synced to our cloud backup service. This means the apps you choose to block remain local to your device. If you reinstall HoiiiBlock or change devices, you may need to choose your blocked apps again.

If you sign in and enable optional cloud backup, the data backed up may include your user ID, email address, streak information, daily exercise totals by date, exercise IDs, exercise completion counts, and update timestamps. Cloud backup is intended to help restore your progress, not to track your app choices.

We are not responsible for data loss caused by uninstalling the app, device failure, operating system restrictions, permission changes, third-party service issues, failure to enable optional backup or sync, or because certain sensitive local data, such as your blocked-app list, is intentionally not synced.

5. Device Permissions

HoiiiBlock may require certain device permissions to work properly, such as usage access, screen time permissions, overlay permissions, notification permissions, or similar platform-specific permissions.

You are responsible for deciding whether to grant these permissions. If you deny, revoke, or restrict required permissions, some or all app-blocking features may not work.

HoiiiBlock does not require camera, microphone, precise location, HealthKit, Google Fit, Health Connect, or contact access for its core app-blocking and exercise-coach functionality.

6. Exercise and Safety Disclaimer

You are responsible for exercising safely and within your own ability. Before using HoiiiBlock exercise features, consider your health, physical condition, environment, available space, flooring, footwear, and any medical restrictions.

Stop immediately if you experience pain, dizziness, shortness of breath, chest discomfort, loss of balance, or any other concerning symptoms. Consult a qualified healthcare professional before beginning or continuing exercise if you have any medical condition, injury, mobility limitation, pregnancy-related concern, or other health risk.

You should not perform exercises in unsafe environments, while driving, while operating machinery, in crowded spaces, near hazards, or anywhere movement could cause injury or property damage.

Kacci Lab is not responsible for injuries, health issues, accidents, property damage, or other harm arising from your use of exercise content or your decision to perform any activity suggested by HoiiiBlock.

7. App Blocking and Unlocking Limitations

HoiiiBlock depends on operating system permissions, platform rules, device settings, app behavior, and technical constraints. We do not guarantee that HoiiiBlock will block every selected app in every circumstance or unlock every app exactly as expected.

Blocking and unlocking features may be affected by:

• Operating system updates
• Permission changes
• Battery optimization settings
• Device manufacturer restrictions
• App store policy changes
• Network or cloud service availability
• Conflicts with other apps, launchers, overlays, accessibility tools, or device management tools
• Device-level restrictions, parental controls, enterprise management, or operating system bugs

HoiiiBlock is a habit-support tool. It is not a guaranteed security system, parental control system, addiction treatment program, productivity enforcement tool, or compliance-monitoring system.

8. Emergency Unlocks, Strict Schedules, and User Settings

HoiiiBlock may include features such as emergency unlocks, strict or focus schedules, unlock windows, per-app exercise stacks, and other user-configurable controls.

You are responsible for configuring these settings appropriately. Emergency unlocks or strict schedules may not be available in every version or on every platform, and their behavior may change as we improve the app or respond to platform requirements.

You should not rely on HoiiiBlock as the only method for managing urgent app access, safety-critical communications, work obligations, school obligations, emergency communications, or legally required access to any app or service.

9. Acceptable Use

You agree not to:

• Use HoiiiBlock for unlawful, harmful, abusive, or fraudulent purposes
• Attempt to reverse engineer, modify, copy, or exploit the app except where permitted by law
• Interfere with or disrupt the Services, servers, or networks
• Attempt to bypass security, authentication, or access controls
• Use the Services in a way that violates platform rules, third-party rights, or applicable laws
• Misrepresent your identity or account information
• Use HoiiiBlock in unsafe environments where exercise may cause harm
• Use HoiiiBlock to control, monitor, coerce, or restrict another person without proper legal authority and consent

10. Free Service and Future Optional Support

HoiiiBlock is free at launch. We do not currently charge for core app features, show ads, require a subscription, or require in-app purchases to use the core app-blocking and quick exercise features.

We may introduce optional donation, tip jar, or support features in the future. If implemented, such features will be voluntary and may be processed through Apple App Store, Google Play, or other approved platform billing systems. Optional support payments will not be required to use the core free features unless we clearly state otherwise in a future update.

If optional paid features are introduced in the future, any applicable pricing, billing, cancellation, refund, and platform rules will be disclosed where required by the relevant app store or payment platform.

11. Third-Party Services

HoiiiBlock may integrate with or rely on third-party services, such as cloud hosting, authentication, crash reporting, diagnostics, app distribution, platform billing, or operating-system services.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, websites, policies, outages, errors, billing systems, or content.

12. Intellectual Property

HoiiiBlock, including its design, software, code, text, graphics, icons, animations, branding, product names, logos, mascot designs, and related materials, is owned by or licensed to Kacci Lab and is protected by intellectual property laws.

Subject to these Terms, Kacci Lab grants you a limited, personal, non-exclusive, non-transferable, revocable license to use HoiiiBlock for your own personal, non-commercial use.

You may not copy, distribute, sell, lease, modify, create derivative works from, publicly display, or exploit any part of HoiiiBlock except as expressly permitted by these Terms or applicable law.

13. User Feedback

If you submit feedback, suggestions, ideas, bug reports, or feature requests, you grant Kacci Lab a worldwide, royalty-free, perpetual, irrevocable right to use, modify, and incorporate that feedback into our products and services without obligation to compensate you.

14. Updates and Changes to the Services

We may update, modify, suspend, or discontinue any part of HoiiiBlock at any time. Features may change as we improve the app, respond to platform requirements, fix bugs, adjust technical implementation, or comply with legal or app store requirements.

We are not liable for any modification, suspension, or discontinuation of the Services.

15. Account Suspension, Termination, and Data Deletion

We may suspend or terminate access to account-based features if we believe you have violated these Terms, created risk or legal exposure for us, abused the Services, or used the Services in a harmful or unlawful way.

You may stop using HoiiiBlock at any time. You may also request deletion of your account and associated cloud data by contacting us at contact.us@kaccilab.com.

Deleting your account or cloud data does not necessarily delete local data stored on your device. You may need to delete the app, reset app data, or use device settings to remove local data from your device.

16. Privacy

Your use of HoiiiBlock is also governed by our Privacy Policy, which explains how we collect, use, disclose, and safeguard information. Please review the HoiiiBlock Privacy Policy carefully.

As described in the Privacy Policy, HoiiiBlock is local-first, account creation is optional, and your blocked-app list is not synced to our cloud backup service.

17. Disclaimer of Warranties

HoiiiBlock is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kacci Lab disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

We do not warrant that HoiiiBlock will be error-free, secure, uninterrupted, compatible with every device, able to block every selected app in every situation, or able to preserve all local or cloud data.

18. Limitation of Liability

To the fullest extent permitted by law, Kacci Lab and its directors, officers, employees, contractors, agents, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, personal injury, device issues, service interruption, inability to access an app, inability to block an app, or other damages arising from or related to your use of HoiiiBlock.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of: (a) the amount you paid to use HoiiiBlock in the 12 months before the claim, or (b) CAD $50.

19. Indemnification

You agree to defend, indemnify, and hold harmless Kacci Lab and its directors, officers, employees, contractors, agents, affiliates, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use or misuse of HoiiiBlock
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Your unsafe exercise activity or failure to follow safety precautions
• Your configuration or use of blocking, unlocking, emergency unlock, or strict schedule features

20. App Store and Platform Terms

Your use of HoiiiBlock may also be subject to the terms and policies of the Apple App Store, Google Play Store, or other app distribution platforms. If there is a conflict between these Terms and applicable platform terms, the platform terms may apply to the extent required by the platform.

Apple, Google, and other app distribution platforms are not responsible for providing maintenance or support services for HoiiiBlock, except to the extent required by their own applicable terms or policies.

21. Governing Law

These Terms are governed by the laws of Ontario, Canada and the applicable federal laws of Canada, without regard to conflict of law principles.

22. Dispute Resolution

Before bringing a formal claim, you agree to contact us at contact.us@kaccilab.com and attempt to resolve the dispute informally. If a dispute cannot be resolved informally, it will be handled by the courts located in Ontario, Canada, unless applicable law requires otherwise.

23. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date above. For material changes, we may provide additional notice in the app, on our website, or by email if you have provided one.

Your continued use of HoiiiBlock after updated Terms become effective means you accept the updated Terms.
