Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the TraceCheck mobile application and related services (collectively, the "Services") operated by Kacci Lab Inc. ("Kacci Lab", "we", "us", or "our").

By downloading, accessing, or using TraceCheck, you agree to these Terms. If you do not agree, do not use the Services.

1. What TraceCheck Does

TraceCheck is an Android application that helps users check a device for known stalkerware indicators and high-risk surveillance-related patterns. TraceCheck may:

• Inventory apps and related package information available on the device
• Compare that information with a locally bundled indicator database
• Flag suspicious permission, Accessibility, Device Admin, hidden-icon, or similar patterns
• Show on-device scan progress and results

TraceCheck is a self-check awareness tool. It is not a guarantee that a device is clean, not a law-enforcement or forensic service, not a medical or counseling service, and not a substitute for professional digital-forensics help in high-risk cases.

3. Eligibility

You must be at least 13 years old to use TraceCheck. By using the Services, you represent that you meet this age requirement and have the legal capacity to agree to these Terms.

If you are using TraceCheck on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

4. No Account Required

TraceCheck can be used without creating an account. Scan processing is designed to happen on your device. Local results or preferences may be lost if you delete the app, clear app data, reset your device, or change devices.

5. Device Permissions

TraceCheck may require Android permissions needed for its core scanning purpose, including package visibility / installed-app inventory permissions. You are responsible for deciding whether to grant these permissions.

If you deny, revoke, or restrict required permissions, some or all scanning features may not work or may produce incomplete results.

TraceCheck does not require camera, microphone, contacts, or precise location access for its core scanning functionality.

6. Important Limitations of Detection

TraceCheck may miss:

• Brand-new or modified stalkerware not yet in the indicator database
• Custom or targeted spyware
• Misuse of ordinary apps (for example, leaving a messaging or baby-monitor app running as a live microphone)
• Shared account access, password sharing, or cloud-account monitoring
• Compromises that require professional forensic analysis
• Nation-state or advanced persistent spyware

Operating system updates, manufacturer restrictions, permission changes, device management profiles, and technical constraints may also affect scan completeness or accuracy.

A flagged result also does not automatically prove that an app is malicious, that a person is being tracked, or that any particular individual installed or used the software. You remain solely responsible for interpreting results, investigating further if needed, and deciding what action, if any, to take.

6A. No Professional Service Relationship; Assumption of Risk

TraceCheck is a consumer software tool, not a professional monitoring, security, investigation, legal, counseling, or forensic service. Downloading or using TraceCheck does not create any duty for Kacci Lab to monitor your device, warn you about future threats, verify findings, remove software, or protect you from harm.

You acknowledge and agree that:

• Detection technology is inherently limited and may produce false positives, false negatives, incomplete results, or outdated matches
• You use TraceCheck and rely on any scan output entirely at your own risk
• You are responsible for staying vigilant about suspicious app behavior, permissions, accounts, and device changes
• Kacci Lab is not responsible for any decision, confrontation, removal action, legal action, safety decision, or other consequence arising from your use of TraceCheck or your interpretation of scan results

7. Safety and Responsible Use

You agree to use TraceCheck only in lawful and responsible ways.

If you may be in an abusive or unsafe situation, using TraceCheck on a monitored phone, sharing scan results, or removing software can create risk. Prefer checking from a safer device when possible. Consider trusted local support resources and guidance from organizations that specialize in technology-facilitated abuse before taking action on a device you believe is compromised.

You agree not to use TraceCheck to:

• Stalk, coerce, intimidate, or unlawfully monitor another person
• Circumvent another person’s privacy, security, or legal rights
• Provide false reassurance that a device is safe when professional help is needed
• Violate applicable laws or platform rules

8. Acceptable Use

You agree not to:

• Use TraceCheck for unlawful, harmful, abusive, or fraudulent purposes
• Attempt to reverse engineer, modify, copy, or exploit the app except where permitted by law
• Interfere with or disrupt the Services, servers, or networks
• Attempt to bypass security, authentication, or access controls
• Misrepresent TraceCheck results as a forensic or legal conclusion
• Use the Services in a way that violates platform rules, third-party rights, or applicable laws

9. Indicator Data and Third-Party Research

TraceCheck may include indicator data derived from publicly available stalkerware research sources. That data is provided for on-device matching and awareness purposes. Research sources may change over time, and indicator coverage is not exhaustive.

Third-party research projects, websites, and datasets are not controlled by Kacci Lab and may have their own terms and privacy practices.

10. Free Service and Future Optional Support

TraceCheck is free at launch for its core scanning features and does not currently show ads or require a subscription for those core features.

We may introduce optional donation, tip jar, or support features in the future. If implemented, such features will be voluntary and may be processed through Google Play or other approved platform billing systems. Optional support payments will not be required to use the core free features unless we clearly state otherwise in a future update.

If optional paid features are introduced in the future, any applicable pricing, billing, cancellation, refund, and platform rules will be disclosed where required by the relevant app store or payment platform.

11. Third-Party Services

TraceCheck may rely on third-party services such as Google Play distribution, Android system services, website hosting, and support tools. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, websites, policies, outages, errors, billing systems, or content.

12. Intellectual Property

TraceCheck, including its design, software, code, text, graphics, icons, branding, product names, logos, and related materials, is owned by or licensed to Kacci Lab and is protected by intellectual property laws.

Subject to these Terms, Kacci Lab grants you a limited, personal, non-exclusive, non-transferable, revocable license to use TraceCheck for your own personal, non-commercial use.

You may not copy, distribute, sell, lease, modify, create derivative works from, publicly display, or exploit any part of TraceCheck except as expressly permitted by these Terms or applicable law.

13. User Feedback

If you submit feedback, suggestions, ideas, bug reports, or feature requests, you grant Kacci Lab a worldwide, royalty-free, perpetual, irrevocable right to use, modify, and incorporate that feedback into our products and services without obligation to compensate you.

14. Updates and Changes to the Services

We may update, modify, suspend, or discontinue any part of TraceCheck at any time. Features, indicator databases, heuristics, and platform support may change as we improve the app, respond to platform requirements, fix bugs, adjust technical implementation, or comply with legal or app store requirements.

We are not liable for any modification, suspension, or discontinuation of the Services.

15. Termination and Data Deletion

You may stop using TraceCheck at any time by uninstalling the app or clearing app data on your device.

We may suspend or discontinue access to the Services if we believe you have violated these Terms, created risk or legal exposure for us, abused the Services, or used the Services in a harmful or unlawful way.

Deleting the app removes local app data from your device according to your operating system behavior. For privacy requests related to information you sent us by email or through our website, contact contact.us@kaccilab.com.

16. Privacy

Your use of TraceCheck is also governed by our Privacy Policy, which explains how we collect, use, disclose, and safeguard information. Please review the TraceCheck Privacy Policy carefully.

As described in the Privacy Policy, TraceCheck is designed for on-device scanning, does not require an account, and is not designed to upload your installed-app inventory to Kacci Lab for scanning.

17. Disclaimer of Warranties

TraceCheck is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kacci Lab disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

We do not warrant that TraceCheck will detect all stalkerware, identify every surveillance risk, be error-free, secure, uninterrupted, compatible with every Android device, or able to preserve all local data.

18. Limitation of Liability

To the fullest extent permitted by law, Kacci Lab and its directors, officers, employees, contractors, agents, affiliates, and licensors will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, personal injury, emotional distress, device issues, service interruption, missed detections, undetected stalkerware, false positives, false negatives, incomplete scans, outdated indicators, reliance on scan results, actions taken or not taken based on scan results, or other damages arising from or related to your use of TraceCheck.

Without limiting the foregoing, Kacci Lab has no liability for any claim that TraceCheck failed to detect a malicious, harmful, unwanted, or surveillance-related package or app, or for any harm allegedly resulting from such non-detection.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of: (a) the amount you paid to use TraceCheck in the 12 months before the claim, or (b) CAD $50.

19. Indemnification

You agree to defend, indemnify, and hold harmless Kacci Lab and its directors, officers, employees, contractors, agents, affiliates, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use or misuse of TraceCheck
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Your reliance on scan results as a complete security or forensic determination
• Actions you take after viewing scan results

20. App Store and Platform Terms

Your use of TraceCheck may also be subject to the terms and policies of the Google Play Store or other app distribution platforms. If there is a conflict between these Terms and applicable platform terms, the platform terms may apply to the extent required by the platform.

Google and other app distribution platforms are not responsible for providing maintenance or support services for TraceCheck, except to the extent required by their own applicable terms or policies.

21. Governing Law

These Terms are governed by the laws of Ontario, Canada and the applicable federal laws of Canada, without regard to conflict of law principles.

22. Dispute Resolution

Before bringing a formal claim, you agree to contact us at contact.us@kaccilab.com and attempt to resolve the dispute informally. If a dispute cannot be resolved informally, it will be handled by the courts located in Ontario, Canada, unless applicable law requires otherwise.

23. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date above. For material changes, we may provide additional notice in the app, on our website, or by email if you have provided one.

Your continued use of TraceCheck after updated Terms become effective means you accept the updated Terms.
